Seg\u00fan la posici\u00f3n del sector, e<strong>l objetivo es corregir supuestas \u201clagunas\u201d dejadas por la normativa.<\/strong><\/p>\n<p>En este sentido, los bancos buscan alertar al Senado estadounidense para que realice las modificaciones necesarias. En una carta enviada por el sector, afirman que esas omisiones podr\u00edan perjudicar al sistema financiero en su conjunto.<\/p>\n<p>La Asociaci\u00f3n Americana de Bancos (ABA, por sus siglas en ingl\u00e9s) propuso ajustes en varios puntos de la Ley GENIUS. <strong>Los m\u00e1s controvertidos est\u00e1n relacionados con el pago de intereses y la regulaci\u00f3n a nivel estatal.<\/strong> Adem\u00e1s, la ABA mostr\u00f3 su oposici\u00f3n a permitir que empresas no financieras emitan estos tokens.<\/p>\n<p>Los bancos criticaron las supuestas<strong> restricciones \u201cd\u00e9biles\u201d<\/strong> de la Ley GENIUS contra los emisores de stablecoins que pagan intereses a los tenedores. Seg\u00fan la ABA, esta deber\u00eda ser una prerrogativa exclusiva de las instituciones bancarias, y no un privilegio extendido a emisores de stablecoins.<\/p>\n<p>La asociaci\u00f3n teme que <a href=\"https:\/\/www.criptofacil.com\/es\/exchange-criptomonedas\/\">exchanges<\/a>, proveedores de monederos y otros servicios puedan esquivar la prohibici\u00f3n, lo que supuestamente <strong>\u201cdistorsionar\u00eda los incentivos de mercado\u201d<\/strong>. UU. y fracaso de cumbre Trump-Putin<\/a><\/li>\n<\/ul>\n<h2>Pol\u00e9mica entre stablecoins y bancos<\/h2>\n<p>De acuerdo con el comunicado, la <strong>ABA sostiene que la expansi\u00f3n de las stablecoins bajo la Ley GENIUS podr\u00eda dificultar el acceso al cr\u00e9dito<\/strong>. Por ello, pide que el Congreso proh\u00edba a los exchanges ofrecer intereses sobre dep\u00f3sitos en stablecoins.<\/p>\n<blockquote><p>\u201cLos bancos impulsan la econom\u00eda transformando dep\u00f3sitos en pr\u00e9stamos; cuando los dep\u00f3sitos se desv\u00edan hacia stablecoins en busca de rendimiento, la creaci\u00f3n de cr\u00e9dito se ve afectada. Para cerrar esta brecha y proteger el sistema financiero, instamos al Congreso a extender la prohibici\u00f3n de intereses de los emisores de stablecoins para que tambi\u00e9n abarque a exchanges, distribuidores y entidades vinculadas a activos digitales\u201d, declar\u00f3 la ABA.<\/p><\/blockquote>\n<p>Seg\u00fan la asociaci\u00f3n, esto \u201cpreservar\u00e1 el papel de los bancos en la intermediaci\u00f3n de cr\u00e9dito\u201d, al mismo tiempo que permitir\u00e1 que la innovaci\u00f3n en pagos digitales florezca de manera responsable.<\/p>\n<blockquote><p>\u201cAl cerrar vac\u00edos regulatorios, preservar el sistema bancario y mantener la separaci\u00f3n hist\u00f3rica entre banca y comercio, el Congreso puede promover una innovaci\u00f3n responsable, proteger a los consumidores, garantizar el acceso al cr\u00e9dito y sostener la estabilidad econ\u00f3mica\u201d, afirmaron las asociaciones.<\/p><\/blockquote>\n<h2>M\u00e1s controversia<\/h2>\n<p>El Bank Policy Institute, el Financial Services Forum, la ABA y otros grupos tambi\u00e9n expresaron recientemente su preocupaci\u00f3n por esta supuesta brecha, que podr\u00eda generar riesgos de liquidez y cr\u00e9dito vinculados a los dep\u00f3sitos.<\/p>\n<blockquote><p>\u201cEl resultado ser\u00e1 un mayor riesgo de fuga de dep\u00f3sitos, especialmente en tiempos de estr\u00e9s, lo que debilitar\u00e1 la creaci\u00f3n de cr\u00e9dito en toda la econom\u00eda\u201d, se\u00f1alaron los grupos. \u201cLa reducci\u00f3n correspondiente en la oferta de cr\u00e9dito se traducir\u00e1 en tipos de inter\u00e9s m\u00e1s altos, menos pr\u00e9stamos y mayores costes para empresas y familias comunes\u201d.<\/p><\/blockquote>\n<p>Sin embargo, Paul Grewal, director jur\u00eddico de Coinbase, neg\u00f3 que exista alguna brecha en la ley.
